With very few parliamentary sitting days left, this is the latest round-up of which States or Territories will be moving to the new Work Health and Safety Act from 1 January 2012.

|Qld||Yes, legislation passed|
|Commonwealth||Yes, legislation passed|
|ACT||Yes, legislation passed|
|Tas||Still expect 1/1/12 start|
|NT||Still expect 1/1/12 start|
|WA||No, deferred AND foreshadowing changes to the legislation|
|SA||No, delayed until at earliest, next sitting of parliament in February|
If you have operations in NSW, QLD, ACT, Tas or NT you should be preparing for the commencement of the new legislation on 1 January 2012 (32 days and counting).
For those businesses that have operations in VIC, WA and SA, notwithstanding the delays in implementation of the legislation, the clear intention is to proceed (once the politicians can get their collective acts together). You should therefore also be reviewing your health and safety procedures in anticipation of the new legislation commencing at some stage in the New Year.
